Governor Phil Murphy recently signed a landmark New Jersey law closing the "stranger loophole" in domestic violence (DV) cases. This law changes the DV landscape for alleged victims seeking a restraining order (RO).

Historically, the legal system left a gap—known as the "stranger loophole"—which meant that people without a prior relationship with their alleged abuser could have difficulty getting an RO. Restraining orders were primarily issued in domestic violence cases or in stalking scenarios involving minors or adults with disabilities.

Expanding the Scope of Protection

Sen. Jon Bramnick (R-Union) was a prime sponsor of the bill. "Gov. Murphy just signed a life-saving bill that will increase protections for victims of stalking who do not have a prior relationship with the defendant," Bramnick said. "In too many instances, the police have been unable to do anything when extremely dangerous or threatening behavior is reported. This new law will make it easier for more victims to get protective restraining orders before frightening conduct escalates to actual harm."

The new law shakes things up by adding stalking and cyber harassment to the list of reasons someone can get a restraining order. What used to be called the Sexual Assault Survivors Protection Act now goes by the Victim's Assistance and Survivor Protection Act. Why the change?
