New Jersey's Adult Protective Services (APS) helps vulnerable adults who live in a community setting, such as senior citizens and adults with disabilities. If you believe you're the subject of elder abuse or think someone you know may be a victim of elder abuse, you should report it so the APS can investigate.
The Family Law Team at the Lento Law Firm can also help with elder abuse cases. We can assist you with filing the report to the APS and help you defend the rights of your loved one. Call 888-535-3686 or send us your case information via our confidential contact form to schedule a consultation.
Reporting to APS
Anyone can make a referral of elder abuse to the APS. In fact, some individuals are mandated reporters, meaning they're required by law to refer any suspicions of abuse to the APS. Your referral stays confidential; the APS doesn't share the information with anyone unless ordered to do so by a court of law.
When submitting a report of elder abuse, be sure to include the victim's name, address, phone number, date of birth, and Social Security number. The APS will also need to know if they have any diagnoses, what their support systems look like, and the specific nature of the abuse allegation.
How an APS Investigation Works
The APS conducts a thorough assessment of every abuse report it receives. It has 72 hours to send a trained social worker to the victimized adult for a face-to-face meeting. At this meeting, the APS social worker will interview the adult in private and determine their independent decision-making ability.
The social worker might interview you if you're the one who made the referral. They can also interview anyone else who might be involved or have information about the potential elder abuse. The social worker then submits their report to a supervisor, who decides if there is abuse, neglect, or exploitation.
What to Do If the APS Finds Elder Abuse
If the APS investigation substantiates your claim of elder abuse, your next call should be to the Family Law Team at the Lento Law Firm. Our attorneys can help you decide what action to take next. It may involve filing a report with the New Jersey Department of Human Services against the care facility where your loved one resides. It could also be reporting a healthcare provider to their state licensing board.
